I wouldn't be so sure the athletic department, and/or Frost come away unscathed here. It's going to be really interesting.
No one's sure of that.

he sent it, didn't he? that's the whole point. he is guilty of distribution.but we dont know if he kept it on his phone or if he recently received it.
If MO sent this video back to the girl, he basically "slut-shamed" a victim of sexual assault.
i am sure everyone involved is going to lawyer up, this program sure does not need a black eye! It's a skeleton statement. These are often released in the immediacy of a situation to say "we're aware." It doesn't necessarily mean anything, but it could mean something. Saying it's odd or strange is equally odd and strange to me. I don't think there's enough there to take anything away from it at all.
Plus, UNL has to be smart. Anything said in a public statement can come back to bite them in the a$$. The last thing they or any entity would want to do is say the wrong thing in a rush.
On Sunday, Washington's attorney, John C. Ball, issued this statement:
“This is a situation involving an inappropriate cell phone video. The allegations are that Mr. Washington sent that video to his high school girlfriend. Mr. Washington did not make the video, nor does he appear in the video. The incident is alleged to have taken place in California, several years ago. Mr. Washington will continue to be fully cooperative with the authorities in this situation. We are in contact with those authorities, and are in the process of making arrangements to move forward and resolve this matter. Mr. Washington has confidence in our justice system, and knows that he can rely on the fundamental constitutional rights of due process and the presumption of innocence.”
Correct, but if it was his former girlfriend, I assume he knew she was only 15.If he knew it was sexual assault.
NOT IF HE DIDNT KNOW SHE WAS 15 IN THE VIDEO he also didnt send it to the world. All we know is SOMEONE sent the girl the video of her having a threesome from several years agohe sent it, didn't he? that's the whole point. he is guilty of distribution.
how is he suppose to know she is 15 in the video? Maybe he received the video shortly before he sent it to her? We dont know squat yet as I have said over and over again.Correct, but if it was his former girlfriend, I assume he knew she was only 15.
One boy connected with the assault was given probation for distribution of child pornography after he sent a recording of the video to classmates, according to NBC Bay Area. He was not charged with sexual assault at the time.
I dont think that is the charge that would stick. the "revenge porn" seems more likely to stick if either does. So, interesting note from The World-Herald's report. I was trying to figure out what California does in terms of punishment for these types of cases. Still trying to track it all down but this is what happened to one person connected to it all:
The video was taken in 2016 and he, along with several other people, received it in 2016. I don't think there is a gray area in him knowing how old she was.NOT IF HE DIDNT KNOW SHE WAS 15 IN THE VIDEO he also didnt send it to the world. All we know is SOMEONE sent the girl the video of her having a threesome from several years ago
