I've mentioned this before in this thread, but most prosecutors will charge as many crimes as possible knowing full well that many of them may not stick or might get plead down. It's a lot like bartering. Both parties shoot their shot and then you find some amicable settling point.

It's whatever entity has jurisdiction over the law, enforcing the law. It's no different than a citizen at a traffic stop - it's them vs. the Police.
