A content item that was meant just for our premium message board on HuskersIllustrated.com was basically lifted and the basis of it was posted on your board.

#5– Do NOT Copy & Paste Original Content from Other Sites

At no times should content be copied and pasted on HuskerBoard without citing the source or linking directly to the content. Exclusive content provided by services such as Rivals and Scout should NEVER be copied and posted on HuskerBoard, even if you own a membership. Material on these sites that is NOT in the membership section can be posted only if you cite the source - or you may link directly to the content.

In reading this section of your rules, a post of mine about prospect Bubba Starling, was basically taken over to your board for all to see for free.

From Rivals: Bubba Starling reportedly clocked a 4.36 in the 40 yard dash yesterday. That is extremely fast for a guy his height!!!

Some of my favorite quotes:

"We're in hell right now, gentlemen. Believe me. And we can stay here, get the sh#t kicked out of us, or we can fight our way back into the light. We can climb out of hell. One inch at a time." -Al Pacino, Any Given Sunday-

"The odds are always against you no matter what your previous history is. You have to overcome the tendency to relax." -Tom Osborne-

"...life's this game of inches. And so is football. Because in either game, life or football, the margin for error is so small. I mean... one half a step too late or too early and you don't quite make it. One half second too slow too fast, you don't quite catch it. The inches we need are everywhere around us. They are in every break of the game, every minute, every second. On this team, we fight for that inch. On this team, we tear ourselves and everyone else around us to pieces for that inch. We claw with our fingernails for that inch. Because we know when we add up all those inches, that's gonna make the difference between winning and losing! Between living and dying!" -Al Pacino, Any Given Sunday-

I don't have an account to HuskerIllustrated - can anyone verify that the post in question is lifted from the pay portion of the site? The post in question is found at https://huskerboard.com/xf/index.php?/topic/40697-qb-bubba-starling/page__view__findpost__p__605931http://www.huskerboa...post__p__605931.

Also, huskernation20 has been warned by Eric about posting paid content, and told that if he did it again he'd be permanently banned. Eric, I assume that still applies if it turns out that he violated that rule again?

I think I'm in huskernation's corner on this one.

I respect the paid services and their need to protect their content. And if 20 is in the wrong, then the post should be removed. In fact, maybe it should just be hidden in the meantime until it's resolved. Sort of like how YouTube takes down videos when they receive a takedown notice, but they can be restored if you successfully fight off the notice. Not a great system but on a smaller scale it's more sensible.

On the other hand, I don't think 20 violated any board rules. Members are definitely allowed and have been giving out information - they just aren't allowed to copy and paste, right?

From Rivals: Bubba Starling reportedly clocked a 4.36 in the 40 yard dash yesterday. That is extremely fast for a guy his height!!!
I don't see how this is substantially different from saying "according to Rivals, was just offered by ____". All it is is a dash time. The content item itself should just be on HI, but that doesn't seem like the content item. Can they keep facts from leaking out to other places? Not sure they have any control over that.

I feel that this should be handled internally (rather than making a public request in the thread) but not a big deal either ways. Just less messy that way (having members clutter the thread with comments about it).

I also feel the burden of proof should be on the HI folk. Maybe we can hide the post temporarily as an injuctive measure in deference to HuskersIllustrated, but ask them to supply the original post in question for purposes of our review of the matter. I don't know, is that a bit much? I suppose it is paid content. Then again, it doesn't strike me as good form for them to email this complaint without providing clear documentation about it.

In any case, there's a lot of gray area in terms of what can be allowed and what can't, I suppose. It's unclear to me that "John Talman's post" was taken over to this board.

But on the other hand, I guess it's not "just" a 40 time either. There's the fact that he ran it yesterday. So even though it's not much, I can see why they would be extremely displeased at a leak such as this. HN20 should probably be advised to be a lot more judicious (and maybe slow, just out of respect for the paid subscribers of HI) with his updates, so that he's not just a direct pipeline of info that pumps out stuff as soon as it gets posted. But I don't think there's a case for a ban here. Unless Mr. Talman can show that his post got the copy/paste treatment. Which I sort of doubt.

This is a bit of a sticky spot because we do have to treat the HuskerIllustrated folk well too, and handle this case cordially and thoroughly for them...I just really don't see it, though.

Mr. Talman sent this email:

Eric, I saw your response to this person’s thread.
I never said it was copied and pasted to you in this e-mail.

I said he took something that I reported on our premium board to a your board. Not “copied and pasted.” It was obviously reworded.

Just want to clear that up before it’s misconstrued.

John
To echo Dave's question, what do they expect? That people will read their site and stay mum about it? If it's not a copy/paste, then I don't know what recourse he has here.

This is sort of interesting. Do they expect people to never talk about what people read on thier site?
I think Tallman is being extremely sensitive. I liken this to seeing something on cable tv and then discussing it with friends or posting it on the web. Do you have to pay rights for that? Are you prohibited from discussing? Are the words "Husker" and "Illustrated" protected from use by any individual without a subscription? Rivals needs to sell subs, but I think this is going a bit far. Do they make members sign a confidentiality agreement stating they will not discuss what has occurred on a Rivals board or posting (even paraphrasing)? If they do not and HuskerNation20 hasn't copied and pasted directly from the Rivals board, I say we let HN20 slide. We issue a reminder to all members to be careful with what they post on our board that has originated from a pay site and let Tallman know that we have it under control. Just my .02.

At first, I was ready to pull the plug on 20, but after a day to think and your responses, we aren't going to do that....but a little fear in the members on posting info from paid sites can't be a bad thing.

I'm on huskernation20 side.

We will make Tallman happy but posting this.

Sound good?

I'm with DJR 100%

I agree, if he didn't copy and paste what it said verbatum then there isn't a violation IMO. If he is just reporting what he read on another board without copy and pasting it then I think we're good on our end. What do you think from your perspective AR?

Are we going to take down the post though? If we don't, I wonder how they will take it, esp. in light of our original response. On the other hand, we should probably make it known the 20 is in the clear before people start thinking he's going to get banned. Eric?

With that HI d00d coming back and saying it wasn't a cut/paste job, oh well. If it isn't direct copy where is the line drawn? Can you be sued for innuendo and hearsay or even the dreaded paraphrasing??

I think Tallman needs to change his tampon more frequently so he doesn't get hemorrhagic fever or somethin'.

We should say something to the guys in that thread. They're bugging out a little, and you can't blame them.

We should reassure them that 20 is in the clear.

We should reiterate that the "no copying of subscriber material" is there to protect them and the board.

We should encourage them to keep discussing recruiting.

We should thank them for being such good members.

I'll do it.
