Online Gambling Report

Hey guys,

I PMd VA Husker Fan recently and it seems he had been wondering about a response to this report filed a long time ago about this 'Online betting' thread. This is what he said:

No, it was about the gambling threads. I reported on one of them a few weeks ago. Given that gambling is illegal in most states, and our AD has taken a strong stance against it, I didn't think gambling threads belong on the board. I didn't get any response and the gambling threads continued. I think the one I reported on was even about where/how to make bets, but I really can't remember. That kind of seems to me like asking where to buy illegal drugs. It's not really that big of a deal, but I at least expected a response if nothing was being done. I didn't think my report was silly or out of line.
Not sure what the legality of that one is. Is it along the same lines as illegal streaming or is that allowed? Report seems to have been closed with no action although I guess he's just looking for an explanation on that, which I can't provide.

That report came during the time that we were having issues with a lot of us not seeing the Reported Posts icon, which probably explains why no one responded.

While I understand what he's getting at, there are some differences between a gambling thread and a illegal stream thread. A few of them are:

1. We don't prohibit illegal streams or such because they violate a criminal statute. Instead, we do it because the illegal streams violate copyright. Current law favors protecting sites like ours in which illegal content is posted (with certain exceptions, such as child porn, etc.) under the proposition that the site is not responsible for the content posted by members. However, if there is a gray area in that regard, it's copyright violation. Conversly, posting threads about gambling sites doesn't appear to jeopardize the board under the law.

2. Gambling may be illegal within certain jurisdictions, but the law is very fragmented - it varies from state to state. Copyright, on the other hand, is pretty uniform. In other words, gambling through off-shore sites could very well be legal depending on each member's jurisdiction. Very hard for us to draw that line.

Ultimately, it comes down to the fact that one of them could cause us problems while the others don't. Letting members post about gambling sites doesn't mean we promote it.
